or"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3379"},"content":[{"type":"text","text":"in writing."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(2)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3380"},"content":[{"type":"text","text":"The Secretary must not give a request under section 35AX orally unless the delay that would occur if the request were to be given in writing would frustrate the effectiveness of the request."}]}]}]},{"type":"heading","attrs":{"id":"v0-p-3381","level":6},"content":[{"type":"text","text":"Notification of requests given orally","marks":[{"type":"italic"}]}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(3)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3382"},"content":[{"type":"text","text":"If a request under section 35AX is given orally, the Secretary must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3383"},"content":[{"type":"text","text":"do both of the following:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3384"},"content":[{"type":"text","text":"make a written record of the request;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3385"},"content":[{"type":"text","text":"give a copy of the written record of the request to the chief executive of the authorised agency; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3386"},"content":[{"type":"text","text":"do so within 48 hours after the request is given."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(4)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3387"},"content":[{"type":"text","text":"If a request under section 35AX is given orally in relation to a critical infrastructure asset, the Secretary must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3388"},"content":[{"type":"text","text":"do both of the following:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3389"},"content":[{"type":"text","text":"make a written record of the request;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3390"},"content":[{"type":"text","text":"give a copy of the written record of the request to the responsible entity for the asset; and"}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3391"},"content":[{"type":"text","text":"do so within 48 hours after the request is given."}]}]}]}]},{"type":"legalListItem","attrs":{"marker":"(5)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3392"},"content":[{"type":"text","text":"If a request under section 35AX is given orally in relation to a critical infrastructure sector asset (other than a critical infrastructure asset), the Secretary must:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(a)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3393"},"content":[{"type":"text","text":"make a written record of the request; and"}]}]},{"type":"legalListItem","attrs":{"marker":"(b)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3394"},"content":[{"type":"text","text":"give a copy of the written record of the request to whichever of the following entities the Secretary considers to be most relevant in relation to the request:"}]},{"type":"legalList","attrs":{},"content":[{"type":"legalListItem","attrs":{"marker":"(i)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3395"},"content":[{"type":"text","text":"the owner, or each of the owners, of the asset;"}]}]},{"type":"legalListItem","attrs":{"marker":"(ii)"},"content":[{"type":"paragraph","attrs":{"id":"v0-p-3396"},"content":[{"type":"text","text":"the operator, or each of the operators, of the asset;
